What Is Probate?

Dealing with the death of a loved one is difficult and often overwhelming. This can be made even more difficult for family members and friends of that individual when they are faced with the often confusing and complex probate process.

Probate is the court procedure required to prove that a will is valid and, with court direction, administer the estate of a person who has passed away in a way that is consistent with their wishes. It can also be a generic term for the entire process of the administration of the deceased person's estate with court supervision, whether or not the deceased person left a will. We assist clients throughout the complex probate process. If the value of the estate is relatively small, it is often possible to administer the estate without court supervision, reducing the cost of the administration.

If the personal representative for the estate, often referred to as the "executor" or the "administrator" of the estate, places their own interests above those of the estate heirs and beneficiaries, does not comply with the terms of the will, or does not comply with their legal obligations as the representative for the estate, the heirs and beneficiaries of the estate have a right to seek legal action to ensure that the estate is administered appropriately.
